# 我们如何在哥伦比亚记录土地控制

下文，我们分享我们的 *现行* 在哥伦比亚的公司规程。这是 *我们的* 文件清单，由我们的社区联络倡导人员为合作的哥伦比亚土地权利律师整理，用于记录土地控制情况，帮助基层农户获得其居住和耕作土地的权利。 

#### 哥伦比亚土地所有权要求。

根据哥伦比亚法律，土地可以以所有权或守护权形式持有。所有权文件：

* **权属证书：** 土地所有权的法定证书。Resguardo证书签发给原住民。 
* ***Escritura***：一种使持有人享有该土地法定所有权的契据。

哥伦比亚政府要求以Escritura或Title作为土地所有权证明的载体，当前国际碳市场认证标准亦然。  

#### 哥伦比亚土地守护权要求。

除所有权外，哥伦比亚法律还通过Compreventa文件承认土地守护、占有或持有。 

* ***Compreventa***：购买协议，虽不足以证明土地的法定所有权，但可为最终过渡至土地所有权提供长期守护的文件证明。 

下文给出将Compreventa转为权属证书的法律要求示例机制。 

#### **表8。哥伦比亚法律下土地守护文件的附加要求**

| 文件        | 要求                                                                     |
| --------- | ---------------------------------------------------------------------- |
| 买卖文件      | 经认证或未经认证的书面文件，示例申请人通过买卖取得财产后，该文件至少应载明签署日期、出卖人和买受人姓名、出售价格、付款方式以及财产详细描述。 |
| 合法占有宣誓书   | 在公证人面前作出的庭外声明，并由两名见证人签署，以证明合法占有。                                       |
| 社区证明      | 证明其为该财产所在地相应辖区社区行动委员会成员的证书。                                            |
| 土地测绘      | 位置图和财产位置。其必须对财产作出真实描述，无论是登记页、地形测量、边界和／或界标描述，均应详细确定财产及其周边区域的位置和面积。      |
| 房产税收据（如有） | 必须证明最近5年已就适用地块缴纳房产税。                                                   |
